Meanwhile, we began work in earnest in the court of public opinion. In Milwaukee, the Journal-Sentinel was unrelentingly hostile. But Mikel Holt’s Community Journal was solidly on our side, castigating Chaney and the Milwaukee NAACP for opposing a program whose primary beneficiaries were black schoolchildren. Chaney explained that school choice had been deployed in the South as a means to evade the mandate of Brown v. Board of Education. True, said the Community Journal, but times had changed. To back its point, the newspaper polled the Milwaukee black community and found 90 percent support for the program.

First, as anticipated, the teachers unions filed a state court lawsuit challenging the constitutionality of the program. In addition, they unleashed the state’s Superintendent of Public Instruction, Bert Grover. Despite having two Sesame Street names, Grover was no friend of children, and declared himself an unrepentant opponent of school choice. In an attempt to sentence the program to death by bureaucratic strangulation, Grover imposed a blizzard of regulations upon private schools. The program required only that participating private schools accept students on a random selection basis and accept the voucher as full payment of tuition.

I accepted eagerly and in 1988, with seed funding from the Lynde and Harry Bradley Foundation, I opened the Landmark Center for Civil Rights in the basement of a townhouse across the street from the Supreme Court. My plans were big but my ‘‘operation’’ oh-so-modest. It lacked even a secretary and filing cabinets when the office opened, and a flood destroyed most of my papers during the first week of operation. When I discovered the disaster, I had to take off my shoes and socks, roll up the pant legs of my suit, and wade out into the muck in the courtyard to clear out the drain.
