At first, the allotted lands were to be held in trust by the United States for 25 years; later amendments made it permissible either to lengthen or shorten the protective trust period, depending on the Bureau's determination of the competency of the allottees. United States citizenship was conferred on Indians receiving allotments under the Dawes Act, and at the end of the trust period allottees were to have the benefit of and be subject to territorial or state laws. The Dawes Act also provided for the acquisition of reservation land by whites.

Another reason for change has been the continuing vulnerability of tribal governments. Even in what can be called the post-reservation era, tribal governments are radically subject to powerful outside forces. S. Congress and the mandates of federal courts, while the more careful observer sees a day-to-day struggle that is increasingly being won by the tribes. This second edition aims to fulfill the latter role. It charts both the occasional one step forward and two steps back and the real progress toward greater self-governance on each of the seven reservations in Montana.

The IRA stipulated that the Secretary of the Interior was to approve both the constitutions and their subsequent amendments. Similarity, rather than distinctiveness, also characterized the new law and order codes adopted by the tribal councils. The presence of the Bureau within the compass of tribal government continued in force. The typical IRA tribal constitution included requirements for the Secretary of the Interior to approve or review tribal council action on such matters as levying assessments on nonmembers trading or residing on reservations, regulating the inheritance of real or personal property other than allotments, providing for the appointment of guardians for minors, and excluding from Indian lands individuals without a legal right to reside upon them.
